  1. The administrator of your personal data is EMBS GROUP Spółka z ograniczoną odpowiedzialnością Spółka komandytowa, located at Aleja Sosnowa 2a, 30-224 Kraków, Poland, KRS 0000524180 NIP 6772383145 REGON 123231543 (hereinafter referred to as the “Administrator”).
  2. For matters related to the protection of your personal data, you can contact the Data Protection Officer appointed by the Administrator at the email address: gdpr@embs-group.com or in writing to the Administrator’s registered office address.
  3. The Administrator processes the data of individuals who:
    1. Provide their data on LinkedIn in connection with using the Administrator’s profile. This data may be available to the administrator of this portal, i.e., LinkedIn. Any personal data contained in comments posted on the Administrator’s profile may also be available to other LinkedIn users.
    2. Sent a private message through the “send message” function to the Administrator’s profile.
  4. Personal data will be processed for the following purposes:
    1. To manage the Administrator’s profile on LinkedIn, under the terms and conditions specified by LinkedIn, and to inform about the Administrator’s activities, promote various events organized by the Administrator, and build and maintain a community related to them.
    2. To communicate through the available functionalities of LinkedIn: comments, chat, messages, or by posting your comment under any of the posts on the Administrator’s profile.
    3. For analytical purposes regarding the analysis of the functioning, popularity, and usage of the profile.
    4. For purposes related to the recruitment process and employment based on an employment contract and a civil law contract (concluding the contract and taking actions at the request of the person whose data is concerned before concluding the contract).
    5. To potentially establish, pursue, or defend against claims.
    6. Based on Article 6(1)(f) of the GDPR, the legitimate interest of the Administrator: promoting its activities and services, managing the social media profile, building and strengthening relationships with clients, conducting analyses and statistics on the popularity and functioning of the profile, as well as establishing, pursuing, and defending against potential claims related to the use of the profile, responding to contact. Additionally, we inform you that LinkedIn Ireland Unlimited Company, located at Wilton Place, Dublin, Ireland, as a tool provider, is jointly responsible for processing the data of individuals using the Administrator’s company profile. This company may process its data for its own purposes on the basis of other legal grounds. In particular, LinkedIn, based on its own terms and conditions, may collect and process information contained in cookies of individuals visiting the profile. Based on such collected data, LinkedIn may create anonymous summaries and statistics (e.g., regarding the number or profile of visitors), which may be made available to the Administrator as the profile manager.   5. Data retention period:
    1. Data processed based on consent will be processed until the consent is withdrawn.
    2. Data processed in accordance with legal requirements will be retained for the duration required by law.
    3. Data processed based on the legitimate interest of the Administrator will be processed until an effective objection is raised or the interest ceases, e.g., data processed to pursue or defend against claims will be processed for a period equal to the statute of limitations for these claims.
    4. Due to the specifics of LinkedIn, information about profile followers, as well as the content of comments, posts, and other information provided by users, is public.
    5. Your data, processed as part of comments posted on the profile, will be available on the service until the author or the profile Administrator deletes them.
  6. Providing personal data is voluntary, but necessary to follow the Administrator’s profile. Processing will be based on the principle of voluntary provision of your data (e.g., following a profile, leaving a comment, etc.).
  7. Your rights regarding the processing of personal data include:
    1. The right to access your data and receive a copy of it.
    2. The right to rectify (correct) your data.
    3. The right to delete data.
    4. The right to restrict data processing.
    5. The right to object to data processing.
    6. The right to data portability.
    7. The right to withdraw consent to the processing of personal data; you have the right to withdraw consent to the processing of this personal data at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
    8. The right to complain to the President of the Personal Data Protection Office (Stawki 2, 00-193 Warszawa, Poland), if you believe that the processing of your personal data violates the provisions of the GDPR.
  8. Information about the source of data: We obtain your data from the LinkedIn provider, from your public profile, and from entries on the Administrator’s profile.
  9. Transfer of data to third countries or international organizations: We do not transfer your data outside the European Economic Area, except for the transnational nature of data flow within LinkedIn. LinkedIn may transfer your data outside the European Economic Area to the United States of America (USA) in connection with its internal sharing with LinkedIn Corporation (1000 West Maude Avenue, Sunnyvale, CA 94085, United States). This transfer is based on Article 45 of the GDPR, which is grounded in the European Commission’s decision on the adequate level of protection, specifically the EU-US Data Privacy Framework.
  10. Personal data will be processed automatically, including profiling. Automated decision-making will be carried out in accordance with LinkedIn’s terms and conditions, and the consequences of such processing may include contact and the display of information from the profile Administrator.
